§ 6.00.06. Waterway subdivision improvements.

  • (a)

    In the event that the owner places any covenants or restrictions on the construction of boathouses, docks and/or the development of beach property within the subdivision, such covenants and restrictions must be on the plat of record.

    (b)

    The minimum waterway width for waterways within the subdivision shall be seventy (70) feet from sea wall to sea wall for waterways. All waterways and adjoining "finger fills" shall be so designated and constructed as to prevent stagnation in said waterways and to enhance tidal action. If sea walls are required, the plans and specifications for the construction of said sea walls shall be submitted to and approved by the city before the commencement of said construction, and said sea walls shall be constructed along the entire length of the proposed waterway.

    (c)

    The maximum projection of boathouses, docks, or other projections into the waterway shall be ten (10) feet.

    (d)

    In the event that waterfront property is developed without the use of sea walls, then in that event the election of the property shall descend to the water level at the rate of one (1) foot of vertical descent for each twelve (12) feet of horizontal distance from the lot line to a minimum depth of five (5) feet of water at mean low water level.

    Methods of enhancing tidal flow. Dead-end canals which connect to the Intracoastal Waterway or the saltwater marshes shall be prohibited. The subdivider shall indicate on the paving and drainage plans any proposed methods to augment tidal action to prevent stagnation in canals.
