§ 4.00.09. Lot clearing permit.

  • Prior to the issuance of a lot clearing permit for new construction, development and/or redevelopment, the applicant shall provide to the city:

    i.

    A survey prepared by a registered Florida land surveyor which clearly depicts the wetland delineation line (per F.S. ch. 373.4211) and required upland wetland buffer line established by a qualified environmental professional.

    ii.

    Documentation prepared by a qualified Florida environmental professional validating that the proposed scope of work is not detrimental to the natural ecological function of the upland wetland buffer.

    iii.

    Existing Vegetative Buffer — Prior to the issuance of a lot clearing permit, should the upland wetland buffer have been determined to contain wetland vegetation by the city, such vegetation shall be preserved and undisturbed with the exception of minimal disturbance, as determined by the city, to the interior side of the perimeter buffer line not to exceed ten (10) feet in depth. The disturbed area shall be replanted with vegetation native to the site, approved by the city prior to the issuance of a permit.

    iv.

    Non-vegetative Buffer — Should it be determined by the city that the upland wetland buffer area is void of vegetation, the upland wetland buffer area shall be replanted with vegetative material(s) consistent with vegetation native to the site utilizing best practices methodology as defined by the department of environmental protection between the outmost boundary of the upland buffer and the boundary of the wetland, saltwater marsh and/or intracoastal waterway prior to the issuance of a permit.

    v.

    Approval of clearing as defined herein does not relieve the applicant from meeting all applicable regulations listed in Section 2.06.09. — Tree and vegetation removal; tree protection.
