§ 4.00.08. Wetland buffers.

  • (a)

    Natural upland buffers.

    Wetland buffer: A natural wetland buffer no less than twenty-five (25) feet in width shall be provided adjacent to and surrounding all wetlands (including saltwater marsh and the Intracoastal Waterway).

    2.

    Wetland buffer establishment: Since avoidance and minimization takes precedence over the upland buffer requirement, under no circumstances will an applicant be authorized to fill jurisdictional wetlands to create the required upland buffer.

    (b)

    Wetland buffer vegetation. Wetland buffer vegetation shall be preserved if natural, or revegetated, if disturbed, between the established wetland buffer setback line and wetland delineation line, saltwater marsh and/or Intracoastal Waterway.

    (c)

    Allowed activities and development within upland buffer areas. Upland buffers adjacent to wetlands shall not be altered nor encroached into except as provided for in Section 4.00.02. Allowed Activities.

    (d)

    Prohibited activities and development within upland buffer areas. See Section 4.00.02.1. Prohibited Activities.
