§ 6-8. Feeding, catching sharks from pier prohibited; penalty for violation.

  • (a)

    In order to protect the public health, safety and welfare of the citizens of Flagler Beach, no person with specific intent shall feed, take, catch, trap or kill sharks of any species whatever from the municipal pier of the City of Flagler Beach, or attempt to feed, take, catch, trap or kill sharks of any species whatever from the municipal pier of the City of Flagler Beach. In addition, the following specific activities are expressly prohibited on the municipal pier of the City of Flagler Beach:

    (1)

    Use of a 6/0 or greater fishing reel in conjunction with a fishing rod; or

    (2)

    Chumming (i.e. dumping cut or ground bait into the water to attract fish to the area being fished).

    (b)

    Except as provided by any rules, regulations or laws of the United States or State of Florida, or any agencies or subdivisions thereof, one (1) unintentionally caught shark per day may be kept and shall not be considered a violation of this section.

    (c)

    Any person violating any of the provisions of this section may be subject to code enforcement proceedings and subject to a fine not to exceed five hundred dollars ($500.00) if found to have committed a violation causing irreparable harm. Any person convicted of violating this section may be responsible to the city for any monies expended by the city as a result of the violation of this section.
