§ 2-73. Definitions.

  • For purposes of this article, the following definitions shall apply:

    Board attorney means the legal counselor who represents the code enforcement board as appointed by the city commission.

    City commission means the duly elected legislative body of Flagler Beach, Florida.

    City attorney means the legal counselor for Flagler Beach, Florida, any assistant or designee as approved by the city commission.

    Code enforcement board means the Flagler Beach Code Enforcement Board if so appointed by the city commission.

    Code enforcement officer means any city manager-designated employee or agent of the city whose duty is to enforce codes and ordinances enacted by the city.

    Repeat violation means a violation of a provision of a code or ordinance by a person whom the code enforcement board has previously found to have violated the same provision within five (5) years prior to the violation.

    Special magistrate means a member of the Florida Bar who presides over code enforcement matters if so appointed by the city commission.
