§ 2-45. Powers and duties.

  • The city manager shall have the power and shall be required to:

    (a)

    See that all laws, provisions of this division, the City Charter, and acts of the commission subject to enforcement by him, or by officers and employees subject to his direction and supervision, are faithfully executed.

    (b)

    Direct and supervise the administration of all departments, offices and agencies of the city, except as provided in the City Charter and ordinances of the city, and including the flow chart adopted with the city personnel ordinance, or as the same might be amended from time to time.

    (c)

    Appoint and, when necessary for the good of the city, remove all officers and employees of the city, except as otherwise provided by the City Charter and ordinances of the city and the rules and regulations promulgated by the personnel ordinance adopted pursuant to law which may permit the manager to delegate to an administrative officer the exercise of these powers with respect to subordinates in that officer's administrative unit.

    (d)

    Establish and recommend to the city commission salaries for city employees.

    (e)

    Plan and prepare the budget annually for action by the city commission and submit to the commission a budget message and capital program in a format to be prescribed by ordinance, and to be responsible for the administration of the budget once it is officially adopted.

    (f)

    Prepare and submit annually to the city commission and the public, a complete report on finances and administrative activities of the city during the previous year.

    (g)

    Keep the city commission and public advised monthly of the financial condition of the city, and to make such recommendations to meet future needs as he may deem advisable for consideration by the commission.

    (h)

    Attend all commission meetings and shall have the right to take part in discussion, but may not vote.

    (i)

    May sign, as one of the three (3) authorized signatories together with and with the approval of the mayor or commission chairman, contracts on behalf of the city pursuant to the provisions of the appropriate ordinances.

    (j)

    Act as the purchasing agent for the city, and shall oversee the purchases as outlined in the purchasing code.

    (k)

    Recommend and, upon approval of the commission, make changes in any or all department organizations, including combinations, deletions, creation of debts, and transfer responsibilities between departments, except where such changes would be in violation of the City Charter, or as otherwise provided in other ordinances of the city. He shall acquire monthly detailed reports from all department heads.

    (l)

    Perform such other duties as are mandated by this division or required by the city commission; provided, however, the commission shall not direct the manager to take any action contrary to the provisions of the City Charter or this ordinance or ordinances of the city.

    (m)

    Enter into no agreements, negotiations or other arrangements with any groups, organizations, governmental bodies or individuals requiring policymaking decisions by the commission without the prior knowledge and approval of that body.
