§ 22-51. Bulkhead lines.

  • There are hereby established bulkhead lines for that area of a portion and body of water known as the Intracoastal Waterway which lies within the corporate limits of the city, the bulkhead line being more particularly described as follows:

    (1)

    On the easterly side of the Intracoastal Waterway the bulkhead line is established one-foot to the east of the right-of-way line of the Intracoastal Waterway, the right-of-way being a five-hundred-foot right-of-way, as presently laid out and maintained by the federal government and the department of the army, corps of engineers;

    (2)

    On the westerly side of the Intracoastal Waterway the bulkhead line is established one-foot to the west of the right-of-way line of the Intracoastal Waterway, the right-of-way being a five-hundred-foot right-of-way, as presently laid out and maintained by the federal government and the department of the army, corps of engineers. Bulkheads that are adjacent to lots 1 through 26 of the Ocean City Subdivision, existing after March 14, 2014, and nonconforming in regards to this subsection, may be replaced in the same location, or to the west, but no further to the east than the existing bulkhead.
