§ 16-16. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meaning ascribed to them in this section, except where the context clearly indicates a different meaning:

    Door-to-door solicitation or sales activities shall mean the conducting of such activities or causing such activities to be conducted at any two (2) or more residential properties within the city within any twenty-four-hour period. Persons conducting sales activities on residential real property as agents of the owner or lawful occupant of such property for the purposes of sale of such residential property, whether under an open listing arrangement or as direct agent of the owner of the property, shall not be deemed to be subject to the terms of this article by conducting sales activities upon the residential properties which are the subject of such agency.

    Itinerant canvasser or solicitor means any individual, traveling either by foot, automobile, motor truck or any other type of conveyance from place to place, house to house or street to street, taking or attempting to take orders for sale of goods, wares and merchandise, personal property of any nature whatsoever for future delivery, or for services to be furnished, or performed in the future, whether or not such individual has, carries or exposes for sale a sample of the subject of such sale or whether he is collecting advance payments on such sales or not, provided that such definition shall include any person who, for himself or for another person hires, leases, uses or occupies any building structure, tent, railroad car, boat, hotel room, lodging house, apartment, show or any other place within the city for the purpose of exhibiting samples and taking orders for future delivery, providing however, that this section shall be inapplicable to the exemptions and exclusions hereinafter set forth in section 16-23.
