§ 6.00.15. Demonstration that development meets land regulations.

  • (a)

    Any subdivision that currently exists within the City of Flagler Beach which has not been developed and is not currently under construction in accordance with the city's current land development regulations, and where roadways and utilities have not been constructed, is declared by the city commission to be un-developable unless within six (6) months of the effective date of this section, the developer of such a subdivision demonstrates by competent, substantial evidence to the city commission's satisfaction that development of the subdivision can meet all the land development regulations currently in effect. Unless actual construction begins within one (1) year of a favorable determination by the commission, the city's determination will expire and be of no further force nor effect.

    (b)

    Anyone seeking a building permit in those undeveloped paper subdivisions may not rely upon the City of Flagler Beach to provide any infrastructure such as roadways and utilities.
