§ 5.03.22. Maintenance of owner deposits, tenant deposits.

  • (a)

    All owners or tenants (in the case where the tenant is responsible for the direct payment of the charges for water services) of property who do not have an unsatisfactory payment history, as described below, served by the city water system shall pay and maintain an owner's deposit in the amount established by resolution, as provided by Section 5.03.39, for owners or tenants with satisfactory payment histories.

    (b)

    An owner or tenant responsible for direct payment of water service charges who has failed to remit payment within thirty (30) days of the due date of such payment two (2) or more times during any consecutive twelve (12) months is deemed to have an unsatisfactory payment history. For any such owner or tenant with an unsatisfactory payment history, the amount of required deposit shall be in the amount established by resolution, as provided by Section 5.03.39, for owners or tenants with unsatisfactory payment histories. Upon determining that an owner or tenant's payment history has become unsatisfactory pursuant to this section, the city shall include on its invoice the additional deposit required. If such additional deposit is not paid within thirty (30) days from the date of the invoice, the city may shut-off water service until such time as the additional deposit amount is paid.

    (c)

    No water service shall be furnished to any property unless the owner's deposit and tenant's deposit, if applicable, are maintained in full.
